LTB and Human Rights tribunal heading towards a new Tribunal

The Landlord and Tenant Board (LTB) along with several other tribunals will be clustered together forming a new Tribunal called " Social Justice Tribunals " . The following tribunals will be combined under the Social Justice Tribunals :

The date when the Social Justice Tribunals will be in operation has not been made  public as of today. They are in the process of hiring an Executive Chair for the Social Justice Tribunals which they expect to have filled by November 2010.The primary role of the above tribunals is adjudicating applications and appeals under various social justice and human rights statutes.

 

 

PSO Resolution Committee

The PSO Resolution Committee continues to file complaints on behalf of our members and we still have issues with the decisions made by Complaints Resolution Department. The decisions are contrary to the Paralegal Rules of Conduct, Ontario Business Corporation Act and the LSUC Act. this is frustrating for our members as they continue to see Business Corporations providing legal services.

Although we still see unauthorized practice of legal services, 3 years post regulation there has been some positive movement for our profession. In a recent case before Small Claims Court, a Claim was thrown out since it was filed by a corporation not licensed to provide legal services. Below is a summary of events:

            Small Claims Court

Canadian Tire vs A.J. Alexandria

St. Catharines Credit Corporation Limited DBA Credit Bureau Services Canada sues A.J. Alexandria on behalf of Canadian Tire Bank. St. Catharines Credit Corporation is listed as agent of record.

Defence filed that St. Catharines Credit Corporation has no standing.
At first settlement conference, paralegal for St. Catharines Credit Corporation requested adjournment to amend claim replacing St. Catharines Credit Corporation with paralegal’s name which was done.
Second settlement conference held, sent to trial.
At trial deputy Judge ruled paralegal could not amend name of agent as original process was a nullity as St. Catharines had no standing to issue the claim as it was signed by employee of collection agency. The claim was dismissed without costs.

The Resolution Committee intends to continue to correspond with the LSUC to reach a clear understanding of their commitment to curb the unauthorized provision of legal services, be it by an individual or business corporation. The committee request that all members continue to forward their complaints to Rick Lammers attention as he says, "We can't stop now".

 

PSO makes submissions on the regulation of Immigration Consultants

On June 12, 2010 the Ministry of  Citizenship and Immigration Canada requested input on applications to regulate immigration consultants. The deadline to make submissions was July 2, 2010.  We thank everyone that called or emailed us to provide their comments on this issue.

Effective JULY 1, 2010 legal fees are subject to 13% HST. 

There are a series of information seminars on Harmonized Sales Tax to help ensure

businesses receive the information they need for the transition to the federal

administraton of the harmonized sales tax in Ontario.

Chris Surowiak, PSO President,  and Member Marshall Yarmus were asked to provide a statement on the motion that was to be schedueld at the May 5, 2010 Law Society AGM.

“Right now, we have a paralegal standing committee, and the paralegals are a minority on their own committee. So they don’t have the power to force change in the law society. If we wait for the lawyers who control the law society to allow paralegals into these areas of practice, we could be looking at many years into the future.” Marshall Yarmus, PSO Member ( former Vice President-ParalegalSociety of Ontario)
